Suppose you own a Trademark and find that someone is holding it hostage as a domain name until you pay a large sum for it, you may be the victim of cyber-squatting. You can sue to get your domain name – and possibly some money damages. Cyber-squatting involves registering, selling or using a domain name with the intent of profiting from the goodwill of someone else’s Trademark. It generally refers to the practice of buying up domain names that use the names of existing businesses with the intent to sell the names for a profit to those businesses. In simple words, cyber-squatting is the act of registering a popular Internet address, usually a company name, with the intent of selling it to its rightful owner. The term cyber-squatting is derived from “squatting,” which is the act of occupying an abandoned or unoccupied space or building that the squatter does not own, rent or otherwise have permission to use. Cyber-squatting is one of the most commonly used terms related to domain name intellectual property law and is often incorrectly used to refer to the sale or purchase of generic domain names.
